Welcome to MyChefStack. These Terms of Use ("Terms") are a legally binding agreement between you and MyChefStack, LLC ("MyChefStack," "we," "our," or "us"), a Texas limited liability company, governing your access to and use of the MyChefStack website, applications, and services (collectively, the "Service").

PLEASE READ THESE TERMS CAREFULLY. By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 13 years old to use the Service. If you are between 13 and 17, you may use the Service only with the involvement and consent of a parent or legal guardian who agrees to be bound by these Terms on your behalf. By using the Service, you represent that you meet these requirements.

The Service is intended for users located in the United States. We make no representations that the Service is appropriate or available for use in other jurisdictions.

2. Accounts

You may browse portions of the Service without creating an account. Certain features require a registered account.

When you register, you agree to provide accurate, current, and complete information. You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. Notify us immediately at support@mychefstack.com if you believe your account has been compromised.

You may not create accounts for others without their permission, use automated means to create accounts, or impersonate another person or entity.

3. Free and Premium Tiers

We offer a free, ad-supported tier and optional paid premium subscription tiers. The features available at each tier are described on our pricing page at mychefstack.com/pricing, which we may update from time to time.

For paid subscriptions: By subscribing, you authorize us to charge your payment method on a recurring basis at the applicable rate. You may cancel your subscription at any time through your account settings. Unless otherwise stated, cancellations take effect at the end of the current billing period. We do not provide refunds for unused portions of a subscription period.

We reserve the right to modify pricing with advance notice to affected subscribers.

4. User-Generated Content

4.1 Your Content

The Service allows you to submit, post, share, and store content including recipes, ingredient lists, photographs, images, written descriptions, comments, reviews, ratings, and other materials (collectively, "Your Content").

You represent and warrant that: (a) you own Your Content or have all necessary rights to grant the licenses described in these Terms; (b) Your Content does not infringe, misappropriate, or violate any third-party intellectual property, privacy, or other rights; and (c) Your Content complies with these Terms.

4.2 License Grant to MyChefStack

By submitting Your Content to the Service, you grant MyChefStack a non-exclusive, worldwide, royalty-free, sublicensable, and transferable license to use, reproduce, distribute, display, perform, adapt, modify, and create derivative works from Your Content for the purposes of operating, providing, improving, and promoting the Service, including for commercial purposes.

You acknowledge that recipes — as collections of ingredient lists and instructions — are generally not protectable by copyright under U.S. law. This license is most significant with respect to protectable elements of Your Content such as original photographs, images, creative written narratives, and other original expression.

This license survives your deletion of content or termination of your account to the extent copies have been distributed, cached, or incorporated into Service infrastructure, subject to reasonable technical limitations.

4.3 License to Other Users

You also grant other users of the Service a non-exclusive license to view and interact with Your Content as enabled by the Service's features (e.g., saving, forking, sharing). Public content you post may be viewed, forked, and built upon by other users consistent with the community features of the Service.

4.4 Recipe Forking and Versioning

The Service includes features allowing users to "fork" (create derivative versions of) recipes shared by other users. Original creators retain attribution across all forks. When you fork a recipe, you acknowledge that your version is derivative of the original and that the original creator's attribution will be preserved.

4.5 Content Moderation

All user-submitted content is subject to moderation before becoming publicly visible to other users. You will be able to see your own content during the moderation period. We reserve the right to remove, restrict, or decline to publish any content at our sole discretion. Repeated violations may result in account action as described in Section 9.

5. Prohibited Conduct

You agree not to:

  • Post content that is unlawful, defamatory, obscene, harassing, threatening, discriminatory, or otherwise objectionable.
  • Infringe or misappropriate the intellectual property rights of others, including posting copyrighted content without authorization.
  • Post false, misleading, or deceptive content, including fabricated nutritional claims or health information.
  • Impersonate any person or entity or misrepresent your affiliation with any person or entity.
  • Use the Service to distribute spam, unsolicited commercial messages, or phishing content.
  • Attempt to gain unauthorized access to any part of the Service or to other users' accounts.
  • Use automated scripts, bots, crawlers, or scrapers to access or collect data from the Service without our prior written consent.
  • Attempt to reverse-engineer, decompile, or disassemble any part of the Service.
  • Interfere with or disrupt the integrity or performance of the Service or its underlying infrastructure.
  • Use the Service in any manner that violates applicable law.

6. Third-Party Recipe Parsing and Import

The Service allows you to import recipes from third-party websites by submitting a URL. You are responsible for ensuring that any recipe you import does not violate the terms of service or intellectual property rights of the source website. MyChefStack extracts only functional recipe data (ingredients, instructions, metadata) and does not scrape or reproduce images from third-party sites.

We make no warranty that recipe import will work for any particular website. Availability of import features may change at any time.

7. AI Features

MyChefStack incorporates AI-powered features including recipe recommendations, meal planning assistance, ingredient substitution suggestions, dietary modification guidance, and a conversational AI assistant (the "AI Sous Chef").

AI-generated content is provided for informational and convenience purposes only. It is not professional nutritional, medical, or dietary advice. You should not rely on AI-generated suggestions as a substitute for advice from a qualified health professional, particularly if you have food allergies, intolerances, or health conditions.

We do not warrant the accuracy, completeness, or safety of AI-generated content. AI features may produce errors or unexpected results. You use AI features at your own risk.

8. Social and Gamification Features

The Service includes community features such as user profiles, recipe sharing, following other users, voting, comments, leaderboards, points, badges, and cooking challenges ("Social Features").

Points, badges, levels, and leaderboard rankings are virtual and have no monetary value. They are provided solely as a gamification feature of the Service. We reserve the right to modify, reset, or discontinue gamification features at any time without liability.

You are responsible for your conduct in connection with Social Features. You agree to treat other users with respect and to not use Social Features to harass, intimidate, or harm other users.

9. Moderation and Account Actions

We maintain a trust and safety system that includes both automated AI review and human moderation. Users who repeatedly violate these Terms or whose content is frequently flagged may have their trust score reduced, which can affect content visibility and account privileges.

We reserve the right to issue warnings, temporarily restrict, suspend, or permanently terminate any account for violations of these Terms, with or without prior notice. The severity of the action will generally correspond to the severity and frequency of violations, but we retain sole discretion over enforcement decisions.

10. Advertising

The free tier of the Service is supported by advertising. By using the free tier, you acknowledge that ads may be displayed to you. We do not allow advertisers to direct our AI features or editorial content. We do not sell your personal information to advertisers.

11. MyChefStack Intellectual Property

The Service and its original content, features, functionality, design, trademarks, service marks, and logos are and remain the exclusive property of MyChefStack, LLC and its licensors. Nothing in these Terms grants you any right to use our trademarks or branding without our prior written consent.

All rights not expressly granted to you in these Terms are reserved.

12. Third-Party Services and Links

The Service integrates with and may contain links to third-party services including social media platforms, health and fitness apps, grocery services, and external recipe sources. These third-party services are governed by their own terms and privacy policies. We are not responsible for the content, practices, or policies of third-party services.

Social media sharing features connect to third-party platforms (Facebook, Instagram, X/Twitter, Pinterest). Your use of those platforms is subject to their respective terms of service.

13. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MYCHEFSTACK DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

Nutritional information provided by the Service is derived from USDA databases and AI analysis and is provided for general informational purposes only. It is not intended as medical or dietary advice and may not be accurate for all preparations or portion sizes.

14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL MYCHEFSTACK, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING UNDER THESE TERMS SHALL NOT EXCEED THE GREATER OF (A) $100 OR (B) THE AMOUNT YOU PAID TO US, IF ANY, IN THE SIX MONTHS PRECEDING THE CLAIM.

Some jurisdictions do not allow exclusion or limitation of certain damages. In such jurisdictions, our liability is limited to the greatest extent permitted by law.

15. Indemnification

You agree to indemnify, defend, and hold harmless MyChefStack and its officers, directors, employees, agents, and licensors from and against any claims, liabilities, damages, judgments, awards, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to: (a) your use of the Service; (b) Your Content; (c) your violation of these Terms; or (d) your violation of any third-party rights.

16. Dispute Resolution and Governing Law

16.1 Governing Law

These Terms and any dispute arising from your use of the Service shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions.

16.2 Informal Resolution

Before initiating any formal dispute, you agree to contact us at legal@mychefstack.com and attempt to resolve the dispute informally. We will attempt to resolve disputes within 30 days of receiving your notice.

16.3 Binding Arbitration

If informal resolution fails, any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, except as provided below. The arbitration shall be conducted in Texas, or by video/phone if agreed by both parties. The arbitrator's decision shall be final and binding.

YOU WAIVE YOUR RIGHT TO A JURY TRIAL AND TO PARTICIPATE IN CLASS ACTIONS. You may only bring claims against us in your individual capacity, not as a plaintiff or class member in any purported class or representative proceeding.

16.4 Small Claims Court

Notwithstanding the arbitration provision, either party may bring claims in small claims court in Texas for disputes that qualify.

16.5 Opt-Out Right

You may opt out of arbitration by sending written notice to legal@mychefstack.com within 30 days of first accepting these Terms. Your notice must include your name, account email, and a clear statement that you wish to opt out of arbitration.

17. Modifications to the Service and Terms

We reserve the right to modify or discontinue the Service or any part of it at any time, with or without notice. We are not liable to you or any third party for any modification, suspension, or discontinuation of the Service.

We may update these Terms from time to time. We will provide notice of material changes by posting the updated Terms to the Service and updating the effective date. Your continued use of the Service after such changes constitutes acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the Service.

18. General

18.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and MyChefStack regarding your use of the Service and supersede all prior agreements.

18.2 Severability

If any provision of these Terms is found to be unenforceable, that provision will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions will remain in full force.

18.3 No Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of that right or provision.

18.4 Assignment

You may not assign your rights under these Terms without our prior written consent. We may assign our rights and obligations without restriction.

18.5 Force Majeure

We will not be liable for any failure or delay in performance resulting from causes beyond our reasonable control, including natural disasters, acts of government, internet outages, or third-party service failures.
